Is Atlanta a No-Fault Divorce Jurisdiction?

Many states have adopted a “no-fault” system for divorce. Instead of requiring divorcing couples to prove that there are valid reasons why the marriage has failed, a no-fault state allows couples to dissolve their marriage regardless of who might be to blame.

Georgia is a “no-fault” and a “fault” state, meaning that a person may simply state that the marriage is irretrievably broken with no hope of reconciliation and obtain a divorce.  However, one may also file on “fault” grounds establishing that one person was a “fault” for the breakup of the marriage.  Examples of common grounds for divorce in Atlanta include:

  • Narcissism
  • The marriage has become irretrievably broken
  • Adultery
  • Habitual intoxication
  • Drug addiction
  • Cruel treatment
  • Mental incapacity that began prior to the marriage
  • Abandonment

Some of these grounds are more commonly cited than others. In fact, most divorces proceed on grounds that the marriage is irretrievably broken.

While it is possible to site any of these grounds in an Atlanta divorce case, some are harder to prove than others. For example, it may be more difficult to prove habitual intoxication or cruel treatment compared to establishing that the marriage has become irretrievably broken. An experienced divorce and family attorney can evaluate all the important factors in your marriage to determine the appropriate legal grounds to cite in your case.

How Can a Lawyer Help with the Family Law and Divorce Process?

An attorney can be an invaluable ally during the divorce and family law process. Filing for divorce is about more than meeting the minimum requirements set by state law and could have a tremendous impact on your financial future as well as your relationship with your minor children.

Child custody issues are often some of the most challenging aspects of divorce and family law in Georgia. Divorcing or unmarried parents do not always see eye-to-eye on what is best for their children. An legal advisor with the Atlanta Divorce Law Group can help you fight for what is fair and reach common ground with your child’s other parent.

A local family law attorney can also assist with the division of assets during divorce. Before a judge can divide your marital assets, you must determine what these assets are worth. Our team can work with appraisal experts to put values on properties and help ensure you get your fair share of the marital estate.

Many divorcing spouses also wonder about whether they’re entitled to any kind of support post-divorce. Alimony—also known as spousal support—is not always granted following a divorce in Atlanta. Many factors can contribute to a judge’s decision to award spousal support in an Georgia divorce case, so it is best to let a legal professional present evidence in an organized and strategic way.

Otherwise, parents—divorced and otherwise—have an obligation to provide for their children. The non-custodial parent will likely have to pay post-divorce support to the custodial parent to help cover the cost of raising their child. Working with our firm can help ensure a fair outcome in your family law or divorce case.
